Presidential Proclamation suspends entry of certain nonimmigrants (H-1B, H-2B, J, and L) following the COVID-19 outbreak

On June 22, 2020, the Trump Administration issued a Presidential Proclamation suspending the entry into the United States of certain foreign nationals in the following nonimmigrant visa classifications: H-1B, H-2B, J-1 (intern, trainee, teacher, camp counselor, au pair, or summer work travel program categories), L-1, and any accompanying dependents. The proclamation goes into effect at 12:01a.m. eastern daylight time on June 24, 2020, and will remain in effect until December 31, 2020.

The Proclamation specifically prohibits the entry into the US of individuals in one of the above nonimmigrant visa classifications who is 1) outside the US as of the effective date of the proclamation; 2) does not have a nonimmigrant visa that is valid on the effective date of the proclamation; and 3) does not have an official travel document such as an advance parole document valid on the effective date or issued thereafter.

The suspension does not apply to lawful permanent residents, spouses and children of US citizens, certain foreign nationals providing services essential to the US food supply chain, and other individuals whose entry to the US would be in the national interest.

The Proclamation also extends the previous Presidential Proclamation issued on April 22, 2020 suspending the entry of certain individuals on immigrant visas until December 31, 2020.
