USCIS returns unselected Fiscal Year 2017 H-1B cap-subject petitions

On July 8, 2016, United States Citizenship and Immigration Services (“USCIS”) announced that it has returned all fiscal year 2017 H-1B cap-subject petitions that were not selected in the computer-generated random selection process.

Because USCIS has never been transparent about how it administers the lottery process, on May 20, 2016, the American Immigration Council and the American Immigration Lawyers Association (AILA) teamed up and filed a lawsuit against the U.S. Department of Homeland Security and USCIS under the Freedom of Information Act (FOIA), seeking information about the government’s administration of the H-1B lottery.
