On January 25, 2019, USCIS announced limited resumption of premium processing availability for certain cases starting January 28, 2019. This applies ONLY to H-1B cap subject/lottery filings for FY2019 that remain pending.
This change affects ONLY those H1B petitions that were filed under the lottery in April 2019. This was a limited resumption of premium processing, and cap exempt H-1B petitions for transfer of employment, or amendment/change petitions, continue to not be eligible for premium processing. USCIS had previously announced its intention to resume premium processing for H-1B petitions by February 19, 2019. To date, USCIS has not provided any updates as to whether it continues to intend to resume premium processing for other H1B petition filing categories as of that date.
