U.S. Chamber of Commerce files 2nd lawsuit against the $100k H-1B proclamation

On October 16, 2025, the US Chamber of Commerce filed a complaint against the $100,000 H-1B fee in the U.S. District Court for the District of Columbia. In addition to outlining economic and public policy arguments against the proclamation, the complaint charges the proclamation with violating the Immigration & Nationality Act, by exceeding the authority granted by Congress to the executive branch. In addition, the proclamation violates the requirement that fees be based on actual cost of processing visa petitions. Further, the complaint charges violation of the separation of powers doctrine if it is a revenue generating measure. This is the second complaint against the proclamation; the first complaint was filed on October 3, 2025, and is summarized in our prior news posting.
