Complaint filed against $100k H-1B proclamation

On October 3, 2025, a coalition of organizations and individuals—including labor unions, healthcare and education institutions, religious organizations, and affected workers— filed a complaint (Global Nurse Force v. Trump, Case No. 3:25-cv-08454) in a federal district court in Northern California, challenging the recent presidential proclamation creating a $100,000 fee for certain H-1B petitions.
The complaint asserts the following:
The fee violates the Constitution’s separation of powers by bypassing Congress’s authority over federal spending.
The proclamation contradicts the statutory framework of the H-1B visa program established by Congress.
The agencies issuing implementing guidance failed to follow required notice-and-comment rulemaking procedures.
The fee is arbitrary, capricious, and harmful to U.S. organizations.
The complaint requests that the court declares the proclamation and agency actions unlawful, and that the court issues an injunction against the $100,000 fee.
