US Department of Labor Resumes Processing of Certain Cases

As of October 31, 2025, the U.S. Department of Labor (DOL) has officially resumed processing employer requests for prevailing wage determinations and labor certification determinations for both temporary and permanent employment in the United States. 


According to the announcement released late Friday, the Office of Foreign Labor Certification (OFLC) has restored full access to the Foreign Labor Application Gateway (FLAG) system.


Employers and stakeholders can now: 

  • Prepare and submit new applications 

  • Submit additional information for pending applications 

  • Receive updates and final determinations 


The OFLC is actively working to ensure a smooth resumption of services, including LCAs for categories like the H-1B, and will continue to provide updates and technical guidance as needed. 


While it appears that submissions are being accepted, it is unclear if DOL will issue certifications while the Government Shutdown continues.
