H-1B visas remain available for coming fiscal year

Per its latest count of accepted H-1B petitions, U.S. Citizenship and Immigration Services (USCIS) has now received 43,000 H-1B petitions against the FY2010 annual cap. A total of 65,000 H-1B petitions are allotted for each fiscal year.

20,000 H-1B petitions have already been received against the special cap exemption reserved for those holding US advanced degrees. However, those holding U.S. advanced degrees can continue to file new petitions against the standard H-1B cap until the 65,000 limit has been reached.

According to the USCIS ongoing count, only 1000 H-1B petitions were received between April 9 and April 13, the date of its last count. If this pace continues, the FY2010 H-1B cap may not be reached for several weeks.
