Original I-485 receipt notice no longer required for travel
published 1 November 2007

USCIS published a revised regulation today, November 1, 2007, removing the I-485 original receipt notice requirement for certain H and L nonimmigrants traveling and returning to the U.S. during the pendency of the I-485 application. The rule is effective immediately, meaning that I-485 applicants who are in valid H or L status and have H or L visa stamps that have not expired are no longer required to carry the original I-485 receipt. Only individuals in H or L status are impacted by this change; all other I-485 applicants must travel with valid advance parole authorization.

Jackson & Hertogs is in the process of reviewing the regulation and will provide additional information regarding how this may impact individual clients.
