H-1B Cap Update as of 9/20/04

According to the American Immigration Lawyers Association (AILA) it is "likely to be "several weeks" before the filing of cap-subject H-1B petitions is cut off for fiscal 2005." This short reprieve is due to "the recapture of unused Singapore/Chile free trade numbers." As we have indicated previously, any unused visas out of the 5800 visas carved out for the Singapore and Chile Free Trade Agreements are to be placed back into the available H-1B cap numbers for use not restricted to citizens of Singapore and Chile. We have not been provided with any usage figures under the Free Trade agreement.

We strongly urge clients who have cap cases to file these immediately.
